By accessing or using our website, or placing an order with us, you agree to be bound by these Terms of Service. Please read them carefully before placing an order.
Nur Scarves is an online retailer offering scarves, hijabs and related products.
The legal contract for purchases made through this website is between you and MALIK BRANDS LIMITED.
Our website is intended primarily for customers purchasing products for personal use. If you are purchasing products for business or resale purposes, different terms may apply.
You agree to use our website only for lawful purposes and in a way that does not:
violate any applicable law or regulation;
infringe our intellectual property rights or those of any third party;
interfere with or disrupt the operation or security of the website;
attempt to gain unauthorised access to our systems or accounts; or
use the website for fraudulent or otherwise unlawful purposes.
We reserve the right to suspend or restrict access to our website where reasonably necessary, including where we suspect misuse or unlawful activity.
We make reasonable efforts to ensure that product descriptions, images, colours, sizes and other information displayed on our website are accurate and up to date.
However, colours may appear slightly different depending on your device, screen settings and other technical factors.
Product images are provided for illustration and presentation purposes. Minor variations in appearance, texture or colour may occur where appropriate to the product.
Nothing in these Terms limits your statutory rights where a product is not as described, is not of satisfactory quality or is not fit for purpose.
All products are subject to availability.
We reserve the right to:
limit the quantity of products available for purchase;
discontinue products;
update product information; or
correct pricing, availability or description errors.
If you place an order for a product that is subsequently found to be unavailable, we will contact you and, where necessary, refund any payment made for the unavailable product.
All prices displayed on our website are in GBP (£) unless otherwise stated.
Prices include VAT where applicable.
We reserve the right to change prices at any time. However, a price change will not affect an order that we have already accepted, except where there has been an obvious pricing error.
If a product is displayed at an obviously incorrect price due to a genuine error, we reserve the right to cancel the order and refund any payment made.
When you place an order through our website, you are making an offer to purchase the selected products.
After placing your order, you should receive an order confirmation by email. This confirms that we have received your order but does not necessarily mean that the order has been accepted.
A contract for the sale of the products is formed when we accept your order and confirm that the products have been dispatched, unless we notify you otherwise.
We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including where:
a product is unavailable;
there has been an obvious pricing or product information error;
we suspect fraudulent or unlawful activity;
payment has not been successfully authorised; or
an order appears to have been placed in breach of these Terms.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled order.
Payment must be made using the payment methods available at checkout.
By submitting payment details, you confirm that you are authorised to use the relevant payment method.
Payments may be processed by third-party payment providers. We do not normally have access to your full payment card details.
Your order will not be dispatched until payment has been successfully authorised or otherwise confirmed.
We will deliver orders to the delivery address provided at checkout.
Available delivery options, estimated delivery times and applicable delivery charges will be displayed during the checkout process.
Delivery times are estimates and may be affected by circumstances outside our reasonable control, including courier delays, severe weather, strikes, customs procedures or other unforeseen events.
We remain responsible for ensuring that goods are delivered within the period required by applicable consumer law.
If your order does not arrive within the expected timeframe, please contact us at info@malikbrands.co.uk so that we can investigate the delivery.
Responsibility for the products passes to you when you, or a person nominated by you who is not the carrier, takes physical possession of the products.
Ownership of the products passes to you once we have received full payment for the products and they have been delivered to you.
Our separate Return & Refund Policy explains our returns process and should be read together with these Terms.
For most online purchases, UK consumer law gives you the right to cancel your order within 14 days of receiving the goods, without having to provide a reason.
If you exercise this statutory cancellation right, you generally have a further 14 days to return the goods.
We will refund eligible cancelled orders in accordance with applicable law. Where required, this includes the cost of standard delivery.
You are responsible for taking reasonable care of products while they are in your possession. Where permitted by law, we may take account of any diminished value resulting from handling beyond what is reasonably necessary to establish the nature, characteristics and functionality of the goods.
Certain products may be excluded from cancellation rights where an applicable legal exception applies. Any such exception will be explained in our Return & Refund Policy and, where appropriate, before you place your order.
Nothing in our returns policy affects your statutory rights.
If you receive a product that is faulty, damaged, incorrect or not as described, please contact us as soon as reasonably possible at info@malikbrands.co.uk.
Your statutory rights under UK consumer law remain unaffected.
Depending on the circumstances, you may be entitled to a repair, replacement, price reduction or refund.
We will not ask you to give up any statutory rights in order to receive assistance with a faulty product.
Where you are entitled to a refund, we will process it using the original payment method unless otherwise agreed or required by law.
Refund processing times may depend on your payment provider or bank after we have processed the refund.
Where applicable law requires us to refund standard delivery charges, we will do so.
From time to time, we may offer promotional discounts, discount codes or other special offers.
Unless expressly stated otherwise:
promotional codes cannot be exchanged for cash;
only one promotional code may be used per order;
promotional codes may be subject to additional conditions;
we may withdraw or amend a promotion where reasonably necessary; and
promotions may have specific start and end dates.
The specific terms displayed with a promotion will take precedence over this section where there is any inconsistency.

We aim to keep the website available and operating correctly, but we do not guarantee that it will always be available, uninterrupted or free from errors.
We may temporarily suspend access to the website for maintenance, updates, security reasons or other operational requirements.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
Our website may contain links to or use services provided by third parties, including payment processors, delivery providers, analytics providers, advertising platforms and social media services.
We are not responsible for the content, availability or policies of third-party websites or services.
Your use of third-party services may be subject to their own terms and privacy policies.
Nothing in these Terms excludes or limits liability for:
death or personal injury caused by negligence;
fraud or fraudulent misrepresentation;
breach of your statutory consumer rights;
liability that cannot legally be excluded or limited; or
any other liability that cannot legally be excluded or limited.
Subject to the above, we will only be responsible for losses that are reasonably foreseeable and arise directly from our breach of these Terms or our failure to meet our legal obligations.
If you are purchasing as a consumer, nothing in these Terms affects your legal rights under applicable consumer protection legislation.
We will not be responsible for delays or failures caused by circumstances outside our reasonable control.
Such circumstances may include natural disasters, severe weather, fire, flood, epidemic or pandemic, industrial disputes, transport disruption, government restrictions, telecommunications failures, cyber incidents, or failures affecting our suppliers or delivery partners.
Where reasonably possible, we will notify you of significant delays and take reasonable steps to minimise their impact.
Our collection and use of personal information is explained in our Privacy Policy.
By using our website, you acknowledge that your personal information may be processed in accordance with that policy and applicable data protection law.
We may update these Terms from time to time to reflect changes to our business, website, products, services or legal requirements.
The version applicable to an order will generally be the version in force when the order was placed.
The latest version will be made available on our website.
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the extent necessary, while the remaining provisions will continue to apply.
If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce that provision later.
These Terms and any contract between you and us are governed by the laws of England and Wales, unless applicable consumer law in your country provides otherwise.
If you are a consumer, you will retain any mandatory rights and protections provided to you by the laws that apply to you.
Any dispute will be subject to the jurisdiction of the courts of England and Wales, except where applicable consumer law gives you the right to bring proceedings elsewhere.
